Afilias makes no warranties with respect to the administration of the .INFO Awards Program (“Program”). Access to the Program website, and the ability to sumit an entry, are provided on an "as-is" basis. Afilias expressly disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Each entrant registry agrees that Afilias will not be liable, under any circumstances, for (a) access delays or access interruptions to the Program website, (b) data non-delivery, mis-delivery, corruption, destruction or other modification, (c) any decisions of the review panel or public voting or (d) events beyond Afilias’ reasonable control. In no event will Afilias be liable to Entrant for any special, indirect, incidental, punitive, exemplary or consequential damages, or any damages resulting from loss of profits, arising out of or in connection with participation in the Program, even if Afilias has been advised of the possibility of such damages. In no event shall Afilias’ maximum aggregate liability to any Entrant arising in connection with the Program exceed One U.S. dollar. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions, Afilias’ liability is limited to the maximum extent permitted by law.
